This section deals with the PC Input Terms and Conditions.
Definitions
Definitions of our terminology within this document:
- 'PC Input' refers to the company trading as PC Input.
- 'Us' refers to the company PC Input.
- 'We' refers to the company PC Input.
- 'Our' refers to the company PC Input.
- A 'Project' is any work undertaken or service provided by the company PC Input, for the Client.
- A 'Client' is a person, persons, business or organisation using any services provided by or on the behalf of the company PC Input.
- 'Content' is both text and images that the Client requires on the website or is used on the PC Input website.
- 'Domain' is the website address as specified by the Client.
- 'Hosting' is a cost charged at regular set intervals to keep a clients website activated online.
- 'Open Source Software' is software that is made freely available to anyone under the GNU General Public License (GPL).
- 'Live' means the period at which a Client's website is publically or privately available on the chosen domain.
- 'Mb' stands for megabytes and is a measure of storage capacity.
- 'Gb' stands for gigabytes and is a measure of storage capacity.
- 'Tb' stands for terrabytes and is a measure of storage capacity.
- 'On Site' is any location that is owned, occupied or provided as a meeting place for PC Input and its staff to carry out services for or on behalf of a Client.
- 'Workshop' means the location at which PC Input operate any services from that are owned, rented or otherwise in use by PC Input.
- 'Technician' is an appropriately qulified member of staff working for or on behalf of PC Input.
- 'Staff' refers to any person working for or on behalf of PC Input.
- 'Minimum Fee' refers to the amount of money chargable for 1 hour at the current first hourly rate.
- 'Current Policy' referes to any pricing, information or other refering practice of PC Input on services, goods or other offerings by PC Input.
Computer Services
1) No call out charge.
The only time you will be charged by PC Input for a call out is if the Technician cannot repair the computer on site due to difficulties caused by the Client (arriving to find that no one is home/on location, coming to set up a network and finding that the Client has not mentioned before that they have no router etc.). In this instance the Client will be charged the Minimum Fee.
2) No fix no fee.
If a PC Input Technician attempts a repair and is unsuccessful you will not be charged. If a Technician has arrived to find that the computer cannot be repaired due to something the Client has done (e.g. forgetting a password, losing any necessary cable etc…) then you will be charged the Minimum Fee or additional fees for any additional works/parts provided in order to continue with the initial request for services/repair.
3) Problems with repair.
If, whilst performing a repair that is relatively simple but something goes wrong (i.e. removing a virus and then finding that the computer doesn’t boot or re-installing windows and we have a power cut which adds additional time to the original quote), we won’t charge the Client anything extra to the original quote the Client was given to perform the additional repairs required to get the computer working again. If however problems arise from known issues that the Client has not told PC Input about or has failed or decided against taking advice from PC Input or its Staff then any additional works and /or parts required to complete the repair will be chargeable (e.g. if we are re-installing windows and the hard drive packs in all by itself and needs replacing) in additional to the original quotation but not before PC Input have informed the Client of the circumstances; at which point the Client is free to have the system back in its not-fully-fixed state with only the quoted works being payable upon return of the system to the Client.
General
- The contract between PC Input and the Client will be on the conditions within this document, to the exclusion of all other terms and conditions. Any variations to these conditions shall have no effect unless agreed in writing.
- The works to be carried out shall be as set out in any PC Input confirmation whether verbally or in written format.
Website Design
- Email will be the method of contact with regard to all confirmational communication for the website design & development. It is the Client's responsibility to inform Us of any change in email address so We always have up-to-date email contact details. PC Input cannot be held liable in any way relating to communication issues if We are not supplied a valid or up-to-date email address. PC Input will acknowledge all emails with a read reciept where the Clients system is set up to request one. .
- PC Input will only commence work on a Project after receipt of a non refundable, Current Policy deposit of the quoted Project fee from the Client. PC Input will also require a further Current Policy payment upon overall approval of the design. The final payment is to be made on completion of the website or before or on the 90th day after the approval of the design if completion is delayed due to the Client. The website will be switched to Live once the Clients remaining balance is paid in full.
- The deposit paid to PC Input covers the cost of any admin work and communication with PC Input and may include the initial design work on some packages. The deposit is always non refundable.
- The unlimited design revisions offered by PC Input end when the Client makes the first payment after the deposit. Changes to the design beyond this point are subject to additional charges.
- PC Input shall expect the Client to carry out sufficient research before proceeding with a website. This shall include checking that the website/idea/business will operate legally. It is important that the website is not in any way illegal. PC Input accept no liablity whatsoever to any website it creates for, or on behalf of, any Client that willfully or unwillfully operates a website that is, or is deemed to be, illegal.
- It is important for the Client to keep in contact with PC Input throughout the entire Project. If a Client does not make contact for 2 weeks (unless notice of such an occurance has been provided) we will make up to 3 attempts to contact the client by email using the email address specified by the Client. If we do not receive a response to these attempts of contact the Project may be terminated, and the deposit will not be refunded. We will levy a £50 admin charge if the Client later returns and wishes to continue work on their Project. PC Input reserve the right to refuse to work with the Client under these circumstances and reserves the right to delete any materials/work completed on the Client's Project. No works carried out on a Client's Project can be transfered to another company or to the Client without full payment of the Project being due.
- Where images used on the website have been purchased by PC Input on behalf of the Client, these images are strictly for use on the website only. PC Input are not liable for misuse of these images by the Client or any other person’s copying, altering or distributing the images to individuals or other organisations.
- PC Input will host the website if the Client requires us to do so and on receipt of full payment of our Hosting fees. In doing so, PC Input will endeavour to provide a reliable and professional service to the Client at all times but do not guarantee that the website Hosting will be available at all times, especially in the event of a technical failure beyond our control.
- PC Input cannot be held responsible for anything adversely affecting the Client's business operation, sales, or profitability that might be claimed is a result of a service offered by PC Input.
- Where asked to provide search engine optimisation for a Client, PC Input do not guarantee any specific placement or high ranking on search engines.
- PC Input do not take any responsibility for a Clients website rank on search engines. This also includes any potential website downtime that can occur. When updating, changing, creating and hosting a Clients website, there could be a change in the websites search engine ranking.
- PC Input will provide the Client with an expected completion date for the Project (Live on the internet) if requested. PC Input will endeavour to meet any given deadline, but do not guarantee and are not bound in any way to complete the Project by this date. The expected completion date provided by any employee of PC Input is purely an estimate.
- It is the Client’s responsibility to check with PC Input whether Open Source Software is being used or not.
- The Client shall not be charged for Open Source Software. If there is a charge for a website using Open Source Software, the Client is paying for the installation time. Open Source Software is not owned by PC Input or the Client.
- PC Input own all design and code of the website until final payment has been received in full. Once final payment is received, the Client will then own the design and code of the website, unless Open Source Software is used. Images will have been purchased by PC Input for the Client, unless the images have been supplied by the Client. Images purchased by PC Input are licensed only for use on the Client website and are limited to no more than 15 images dependent on the size of the project. Item 15 is subject to item 16.
- All images displayed on the Client's website will only be used after authorisation by the Client, and are the sole responsibility of the Client regarding usage and copyright. Should any legal issues or claims arise from the content or copyright of any images supplied by the Client or PC Input, they will be the sole responsibility of the Client. This clause excludes images which are provided by PC Input.
- Domain names will be registered by PC Input on belf of the Client and will be the property of the Client unless monies due for the domain name are not recieved by the renewal date at which point the domain name will be transfered to and owned by PC Input who can then decide to do as they wish with the domain name including charging a re-purchase premium to the original Client or selling-on the domain name.
- A domain name will be registered by PC Input on behalf of the client seperately to any other fees, unless a package or offer exists that includes the purchase of a domain name at which point the registration of the doman name will be at a time entirely at the discretion of PC Input. PC Input cannot accept any liability for loss of potential or actual domain name in this or any other event where the desired domain name is subsequently purchased by another.
- It is the responsibility of the Client to renew their domain names when due. If a domain name expires, PC Input can not be held liable for this. However, PC Input will make reasonable effort to contact the Client regarding domain renewal.
- When a Client renews Hosting with PC Input, this also includes domain renewal if the renewal is needed to keep the site functioning and was purchased as part of the Hosting package. If the Client does not renew the Hosting, their domain name could be made available to the public for purchase and PC Input cannot be held liable for this.
- Renewal of Hosting is due on at regular intervals. The date of renewal will be at regular intervals from the date the website was made Live. The Hosting will not be renewed if PC Input cannot contact the Client or the Client requests for PC Input to not host this site. This will also affect the domain as per item 20.
- The Hosting renewal charge must be received on or before the day of the Hosting expiry date. PC Input reserve the right to deactivate any website and notification of such an occurance made public on the Client's site where the Hosting has expired and the Client has not paid the renewal charge. There will be an admin fee set by PC Input for reactivating the website/Hosting.
- If the Client does not use PC Input Hosting services, then the management and Hosting of the Domain name are the full responsibility of the Client.
- Should a Client wish to move Hosting away from PC Input or transfer a Domain name away from PC Input, a £50 admin charge and £25 admin charge respectively will be issued, which must be paid before the transfer takes place.
- PC Input has no control of, or responsibility for, the content of Clients’ websites. In no way does the textual or image based Content of our Client's web sites constitute PC Input's endorsement, or approval of the website or the material contained within the website. PC Input has not verified any of the materials, images or information contained within our Client's web sites and is not responsible for the content or performance of these sites or for the Client's transactions with them. PC Input provides links or references to our Client's websites solely for the convenience of prospective customers and intends that the links it provides be current and accurate, but does not guarantee or warrant that such links will point to the intended Client site at all times.
- PC Input shall place a text and/or picture link on the Clients website that simply states in some manner that the website was designed, created and hosted by PC Input and links to Our company website.
- PC Input are not liable for loss, damage or corruption to files or information stored on its servers or individual PCs relating to a Client's website. The Client is solely responsible for any information or files relating to its website unless agreement otherwise or managed website package has been accepted by PC Input and the Client
- If a Domain name is purchased by the Client through a company other than PC Input, the Client has full responsibility in making sure that the domain name is renewed when due. PC Input will not renew the Domain name when annual Hosting renewal is due if the Domain name is purchased through a company other than PC Input.
- Payment for website design will incur a 3.5% service charge payment on any payments received using a credit or debit card. If this is not acceptable to the Client, we also accept Cash, BACS and Cheque as an alternative payment method and there is no additional service charges for these payment types.
- PC Input makes no claims that the contents of this website may be lawfully viewed or downloaded outside the United Kingdom. Access to this website may not be legal by certain persons or in certain countries. If this website is accessed from outside of the United Kingdom, it is done at own risk and the visitor is responsible for compliance with the relevant laws of the visitor’s jurisdiction. The terms and conditions of this website are governed by the laws of England and Wales. Jurisdiction for any claims arising in respect of this website’s Content shall lie exclusively with the courts of England. If any provision of these terms and conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these terms and conditions, which shall remain in full force and effect.

This agreement applies as between you, the User of this Web Site and PC Input, the owner(s) of this Web Site. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the Web Site. If you do not agree to be bound by these terms and conditions, you should stop using the Web Site immediately.

By continuing to use the Web Site you acknowledge that such material is protected by applicable United Kingdom and International intellectual property and other relevant laws. You may not reproduce, copy, distribute, store or in any other fashion re-use material from the Web Site unless otherwise indicated on the Web Site or unless given express written permission to do so by PC Input.

This Web Site may contain links to other sites. Unless expressly stated, these sites are not under the control of PC Input or that of our affiliates. We assume no responsibility for the content of such web sites and disclaim liability for any and all forms of loss or damage arising out of the use of them. 6.1 PC Input makes no warranty or representation that the Web Site will meet your requirements, that it will be of satisfactory quality, that it will be fit for a particular purpose, that it will not infringe the rights of third parties, that it will be compatible with all systems, that it will be secure and that all information provided will be accurate. 7. Availability of the Web Site

Users should be aware that they use the Web Site and its Content at their own risk.
8.2 Nothing in these terms and conditions excludes or restricts PC Input's liability for death or personal injury resulting from any negligence or fraud on the part of PC Input.
8.3 Every effort has been made to ensure that these terms and conditions adhere strictly with the relevant provisions of the Unfair Contract Terms Act 1977. However, in the event that any of these terms are found to be unlawful, invalid or otherwise unenforceable, that term is to be deemed severed from these terms and conditions and shall not affect the validity and enforceability of the remaining terms and conditions. This term shall apply only within jurisdictions where a particular term is illegal.
9. No Waiver
In the event that any party to these Terms and Conditions fails to exercise any right or remedy contained herein, this shall not be construed as a waiver of that right or remedy.
10. Previous Terms and Conditions
In the event of any conflict between these Terms and Conditions and any prior versions thereof, the provisions of these Terms and Conditions shall prevail unless it is expressly stated otherwise.

These terms and conditions and the relationship between you and PC Input shall be governed by and construed in accordance with the Law of England and Wales and PC Input and you agree to submit to the exclusive jurisdiction of the Courts of England and Wales.
